Heritage Finds – Terms & Conditions
About Heritage Finds
Heritage Finds is a UK-based sourcing service specialising in antique and vintage items. We locate, negotiate, and arrange purchases of unique pieces on behalf of private clients, collectors, and designers.
Services Provided & Role of Heritage Finds
Heritage Finds offers a bespoke sourcing and introductory service for antiques, vintage, modern, and collectable pieces. Our role is to assist clients in identifying potential items of interest, to introduce buyers and sellers, and to facilitate secure payment arrangements via escrow. Escrow is a secure, UK-regulated arrangement where a neutral third party holds funds until both buyer and seller meet the agreed terms, safeguarding your money under UK law.
Heritage Finds acts solely as an introducer and sourcing agent. We are not the buyer, seller, or owner of any goods. We introduce clients to potential sellers, assist in agreeing on terms, and facilitate escrow payments. Heritage Finds does not handle, ship, or store items. We do not provide valuations or guarantees unless expressly agreed in writing as a separate service.
Fees, Payment and Payment Terms
All fees are agreed in advance and confirmed in writing (by email). No payment is required until the Buyer has approved the Item and confirmed they wish to proceed. Heritage Finds’ commission is deemed earned and non-refundable once funds are deposited into escrow, and is always payable to Heritage Finds regardless of whether the transaction ultimately completes.
The remaining balance is held securely in escrow by Transpact.com and will only be released to the Seller in accordance with the Buyer–Seller written agreement. Payments are made solely through escrow and strictly under these terms and the agreed written contract between Buyer and Seller.
Sale Confirmation by Email
-
The Buyer must email the Seller confirming the agreed purchase price and any specific terms (such as delivery or inspection).
-
The Seller must reply by email confirming acceptance of the Buyer’s terms.
-
The Seller must either forward this exchange to Heritage Finds at heritagefindsuk@gmail.com, or copy Heritage Finds into the reply, so that both parties’ agreement is on record. Only once this written confirmation is received by Heritage Finds can the Buyer proceed to pay the agreed amount into escrow. Funds will only be released from escrow in accordance with these Conditions of Sale and the confirmed written terms held on record by Heritage Finds.
Escrow & Commission
The Buyer shall pay the full agreed purchase price into Transpact.com’s escrow account. All payments are handled securely through Transpact.com.
A small £5.98 processing fee (for GBP transactions) is shared between the buyer and seller. Heritage Finds charges a sourcing commission, paid by the buyer only, which covers our work finding and arranging the item.
Total for the buyer = Item price + Heritage Finds commission + Buyer’s share of Transpact fee
Seller receives = Item price – Seller’s share of Transpact fee
⚠️ Important Escrow Rule
-
Payment out of escrow will only ever be made according to these Conditions of Sale and the written agreement between the Buyer and Seller (as emailed to Heritage Finds at heritagefindsuk@gmail.com).
-
If a matter is not addressed in these Conditions or in the Buyer–Seller written agreement, it is considered undefined. In such cases, payment may be at risk, and both Buyer and Seller must accept that Transpact.com can only act on what has been clearly agreed in writing (email or text).
-
In other words: If it is not written down, texted, or emailed, it will not be paid out. This protects both Buyer and Seller by ensuring there are no surprises.
Client Responsibilities
Clients are responsible for providing accurate information regarding their sourcing requirements. Where items are purchased, the client (as buyer) is responsible for due diligence in confirming that the item meets their needs, and for complying with any legal or import/export requirements relevant to their jurisdiction.
Disputes & Limitation of Liability
-
All contracts of sale are strictly between the buyer and the seller. Heritage Finds makes no warranties or representations regarding the description, authenticity, provenance, condition, quality, or suitability of any item. Responsibility for these matters rests exclusively with the buyer and seller.
-
Any disputes relating to misdescription, authenticity, non-delivery, defects, or return/refund claims must be resolved directly between the buyer and seller, or through Transpact’s dispute resolution process. Heritage Finds is not a party to such disputes and accepts no liability in relation to them.
To the fullest extent permitted by law:
-
Heritage Finds excludes all liability for any loss, damage, costs, or claims arising from transactions between buyers and sellers.
-
Our liability is strictly limited to ensuring that payments are processed correctly via escrow and that our commission is properly deducted.
-
We are not responsible for the condition, description, authenticity, or suitability of any item sourced.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
